We provide this privacy statement, which relates solely to data collected as part of the online application process, to inform you about how we handle your personal data collected by us as part of the application process.

Personal data in the context of the application process

Personal data is information about the personal or factual circumstances of an identified or identifiable natural person. This includes information such as your name, your address, your telephone number and your date of birth, but also data about your specific career, etc., which can be assigned to a specific person with reasonable effort. Information that is not (un)indirectly associated with your real identity, on the other hand, is not personal data.

Principles and purposes for processing personal data in applications and in the application procedure

If you apply to us electronically, i.e. by e-mail or via our web form, we will collect and process your personal data for the purpose of processing the application procedure and carrying out pre-contractual measures.

By submitting an application on our recruiting page, you express your interest in taking up employment with us. In this context, you provide us with personal data which we use and store exclusively for the purpose of your job search/application.

In particular, the following data is collected:

Name (first and last name)
E-mail address
Telephone number
Entry date
Salary requirement

You also have the option of uploading meaningful documents such as a cover letter, your CV and references. These may include further personal data such as date of birth, address, photo, etc. Only authorised employees from the personnel department or employees involved in the application process have access to your data.

Personal data is stored exclusively for the purpose of filling the vacant position for which you have applied. Your data will be stored for a period of up to 6 months beyond the end of the application process. As a rule, this is done to fulfil legal obligations or to defend against any claims arising from legal regulations. We are then obliged to delete or anonymise your data. In this case, the data is only available to us as so-called metadata without direct personal reference for statistical evaluations (for example, proportion of women or men in applications, number of applications per period, etc.).

If you agree in advance, we may store your data for inclusion in our „talent pool“ for up to 12 months after the end of the application process in order to identify any other interesting positions for you. This also applies, for example, to applications for apprenticeships or internships.

You will not be informed separately about the deletion of your data.

If you receive an offer of employment with us during the application process and accept this offer, we will store the personal data collected during the application process for at least the duration of the employment relationship.

Legal basis

The legal basis for the processing of your personal data in this application procedure is Art. 88 DSGVO in conjunction with. § Section 26 BDSG in the currently applicable version. Accordingly, the processing of data required in connection with the decision on the establishment of an employment relationship is permissible.

Should the data be required for legal prosecution after the application process has been completed, data processing may be carried out to safeguard legitimate interests in accordance with Art. 6 Para. 1 lit. f DSGVO. If you agree to the storage in our talent pool, the legal basis for this is Art. 6 para. 1 lit. a DSGVO.

Transmission of data

After receipt of your application, your applicant data will be viewed and processed by the Human Resources Department. Suitable applications are then forwarded to the person responsible for the department or their authorised representative for the respective open position. In principle, only those persons in the company have access to your data who require it for the proper conduct of our application procedure.

The data transmitted as part of your application will be transferred via TLS encryption and stored in a database. This database is operated by Personio GmbH, which provides personnel administration and applicant management software (https://www.personio.de/impressum/). Personio is our order processor in this context in accordance with Art. 28 DSGVO. The basis for the processing here is an order processing contract between us as the controller and Personio.

Data subject rights

If personal data is processed by us as the data controller, you as the data subject have certain rights under Chapter III of the EU General Data Protection Regulation (GDPR), depending on the legal basis and the purpose of the processing, in particular the right to information (Art. 15 DSGVO), right to rectification (Art. 16 DSGVO), right to erasure (Art. 17 DSGVO), right to restriction of processing (Art. 18 DSGVO), right to data portability (Art. 20 DSGVO), right to object (Art. 21 DSGVO). If the processing of personal data is based on your consent, you have the right to revoke this consent under data protection law in accordance with Art. 7 III DSGVO.

Please contact our data protection officer to assert your data protection rights with regard to the data processed in this online application procedure (see point 2.).

Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority if you consider that the processing of personal data concerning you infringes the GDPR.

Necessity of providing personal data

The provision of personal data is neither legally nor contractually required, nor are you obliged to provide it. However, the provision of personal data is necessary for the implementation of the application procedure and for the conclusion of an employment contract. If the data is not provided, it will not be possible to carry out the application procedure or conclude a contract.

Decision making and profiling

As a matter of principle, we do not use automated decision-making in accordance with Article 22 of the GDPR to justify and carry out the application process. Likewise, we do not use automated processing of your personal data to evaluate personal aspects (profiling) pursuant to Art. 4 No. 4 DSGVO.

Processing for other purposes

If babymarkt.de GmbH further processes your personal data for a purpose other than that for which it was collected, we will provide you with information about that other purpose and any other relevant information separately before such further processing.

Concluding provisions

We reserve the right to adapt this privacy policy at any time so that it always complies with the current legal requirements or to reflect changes in the application process or similar. The new data protection declaration will then apply for a renewed visit to this recruiting page or a renewed application.
